India’s judicial system, often hailed as the guardian of democracy, is deeply entrenched in casteism, Brahmanism, and patriarchy. Amidst this, a historic change has taken place. Justice Bhushan Ramkrishna Gavai has been appointed as the 52nd Chief Justice of India (CJI), making him the first Buddhist and the second Dalit to ever hold this position after Justice K.G. Balakrishnan. This is not just an appointment; it’s a symbolic break in the upper-caste dominance of India’s judiciary. However, the harsh truth is that the Indian judiciary still remains an elite club where Dalits, Adivasis, OBCs, minorities, and women are vastly underrepresented. According to Law Ministry data, less than 25% of High Court judges belong to SC, ST, OBC, and minorities combined, and only 13.5% are women.
