
'Touching girl's cheek without intent to sexually assault her is not a sexual assault': Bombay HC grants bail to accused
- The Bombay High Court has granted bail to a 46-year-old man accused of sexually assaulting an eight-year-old girl.
- It said that touching the cheeks of a child without the intent to sexually assault a child is not an offence.
- A single bench of Justice Sandeep Shinde granted bail on August 27 to accused Mohammad Ahmed Ulla, who was arrested in July 2020 by the Rabodi police in neighbouring Thane district.
- The High Court said, "From the preliminary evaluation of the documents available on record, it does not appear that the petitioner touched the cheeks of the victim to sexually assault her.''
- However, Justice Shinde made it clear in the order that the remarks made by him should be construed as the opinion given for bail in this case and would not have any bearing on the hearing in other cases.
