
"It is the responsibility of states not to register a case under the repealed section 66A of the IT Act"- Center to SC
- The Central Govt has filed an affidavit in the Supreme Court saying that after scrapping the Section-66A provision of the IT Act, it is the primary duty of the states and UTs to close the cases registered under it.
- The law-abiding agencies under the state governments have been asked to ensure that no new cases are registered under Section-66A of the IT Act.
- The affidavit filed by the Centre in the Supreme Court states that police and administrative system are state subjects as per the Constitution of India.
- It added that the prevention, investigation and prosecution of crimes and capacity building of police personnel are primarily the responsibility of the states.
- The Central Govt has given this affidavit on the petition of NGO PUCL, in which it has been said that despite the repeal of Section-66A, cases are being registered under it.
