Twelve TRS MLAs led by V. Prashant Reddy on Friday filed a petition before a Division Bench of the High Court challenging the order of the single judge who quashed the expulsion of two Congress MLAs Komatireddy Venkat Reddy and S.A. Sampath Kumar.
The MLAs contended that the action of the Assembly in expelling the MLAs was justified as they besmirched the privilege and dignity of the House. It was an affront to their rights as members of the State Legislative Assembly. The legislators maintained that the court did not have jurisdiction over the resolution adopted by the House.
The Division Bench comprising Acting Chief Justice Ramesh Ranganathan and Justice K. Vijaya Lakshmi, however, sought to know from the petitioners’ counsel how they constitute ‘necessary parties’ to the case as they were not among the respondents in the writ petition filed by Congress MLAs over their expulsion. The counsel said his clients sought to implead in the case as they were also party to the resolution.
