Reality of triple-talaq
Triple talaq is a 1400 years old practice in a Muslim community named Sunni. It is a method for dissolving the pious bond of marriage by uttering Talaq thrice in one row; which is not at all mentioned in the Sharia law. But few managers of dharma have misinterpreted the law and have connected this malpractice with the threads of religion. Although as per Quran, there are two further means to avoid hasty divorces, it prescribes two waiting periods of three months before the divorce is final in order to give the husband time to reconsider his decision. The man takes an oath not to have sexual intimacy with his wife, which would lead to automatic divorce, is allowed a four-month period to break his oath. Moreover, there is no provision of saying talaq thrice at once. Even if we give a look on the pages of history Khalifa-Umar himself had punished a man for giving instant triple talaq to his wife with 40 hits of a hunter.
Patriarchic blindfold over Quranic interpretations
But it is really painful to see that even today people are not ready to open up their blindfolds regarding the issue; women themselves are still openly supporting the practice of triple talaq. Organizations who claim to govern the Muslim laws i.e. All India Muslim Personal Law Board (AIMPLB) is the biggest opponent of triple talaq bill issued by Supreme Court and have tagged it as anti-muslim and anti-women law. They blame that that it had snatched the right to divorce from men. What rights are they talking about?
Right which gave talaq to Sheeba of Hardoi through SMS in May 2018 or the right which gave talaq to Huma Saira of Hyderabad this month from a wats app message. If these are the rights they are talking about then AIMPLB must be knowing that in extreme cases there is also a provision for females under which females get right to divorce i.e. “Khula”. But women have never used that. Therefore this so-called ‘Right’ of AIMPLB is not their right but a dominant patriarchy in its ugliest form.
It’s shameful to know that triple talaq is the easiest and most common method of divorce among Indian Muslims. According to a survey conducted by the Bharatiya Muslim Mahila Andolan (BMMA), out of all the divorced Muslim women, 65.9 % were divorced verbally, 7.6% were divorced through a letter, 3.4 % were divorced over a phone call. All in all, 78% of women were divorced unilaterally and 95% of divorced women received no maintenance from their husbands. In many cases, the women were not in a position to take care of their kids.
In the light of the above, i.t is clear that the way Muslim community is using triple talaq is un-Quranic. Moreover, the method is completely a spirit against the laws mentioned in the Quran. It is more of an unjust and inhuman way created under the misleading patriarch society; which makes women homeless overnight. In order to support the rights of Muslim women, Modi government formulated a bill called “The Muslim Women(protection of rights on marriage) Bill”, which got passed by Lok Sabha on 28th December 2017. And now an ordinance is passed by Supreme Court on 20th September 2018 stating triple talaq to be a criminal offense.
Those who see the society with the orthodox spectacle of religion are still criticising it a lot. The ultimate beneficiaries of the law are themselves standing against it. Therefore, in order to support the bill a noted literary and social commentator, Ziya-Us-Salam wrote a book “Till Talaq do us apart” which enlightens the unbiased understanding of triple talaq under the light of Quran.
